New regulations introducing an appeals process to challenge NHS England recovering overpayments to pharmacy contractors will come into effect on August 1.

As part of the pharmacy provider assurance programme, contractors will have 30 days in which to appeal if notified of an overpayment decision by NHS England, said PSNC. “The appeal must be made to an officer or employee of the NHS Litigation Service or a committee established in accordance with the Directions (in practice this means the Primary Care Appeals Service (previously the FHSAU) of NHS Resolution).”

PSNC said that the new regulations address the lack of mechanism for an appeal in the 2013 regulations, despite the regulations referring to an appeal process. “This was noticed as part the development of the NHS pharmacy provider assurance programme and, at PSNC’s request, NHS England agreed not to seek to recover overpayments until an appeal mechanism had been made available to contractors.”

Now that an appeals mechanism is provided for in the regulations, NHS England will be developing a national approach for the recovery of overpayments which PSNC says will be tested before being accepted as standard.
